EU Commission publishes radical overhaul of Data Protection Framework , not all of which is welcome said Ian Twinn

The new proposals to overhaul the Data Protection Framework from Mrs Reding, EU Commissioner for Justice, Citizenship and Fundamental Rights, are a radical departure from the present directive. 

Ian Twinn, ISBA Public Affairs director said ‘There are some welcome ideas in the proposal but we fear one unwelcome result will be that advertising in the digital environment will become more difficult and significantly undermine the ‘free’ access to digital content that consumers have come to expect.’ 

The plans announced today review the 1995 Data Protection Directive. They will now be passed on to the European Parliament and to the Council of the European Union (representing national governments) for debate and votes over the next few years. 

During this time significant changes may be made for better or for worse. 

Amongst the changes are plans for a EU wide Regulation rather than a Directive subject to Member State interpretation; new powers for Regulators; Personal data definition expanded to include cookies; and ‘consent’ redefined to mean ‘explicit’ rather than ‘unambiguous’.
